ICO ‘FAILS’ to Investigate – Illegal Recordings & Surveillance, by Neighbours & Authorities!

In March 2018 directly after Mr Foenander’s first complaint the Aldwyck Housing Group and Dacorum borough council, about the dangerous electrics and loss of electric taking place. The authorities allowed people who lived in Flat 5 Aldwyck Court, next door to Flat 6 Aldwyck Court, to take illegal recordings of Mr Foenander, which caused a breakdown in Mr Foenander’s mental health to relapse into paranoia, anxiety and depression.

THE DACORUM COUNCIL WERE ILLEGALLY LISTENING INTO MR FOENANDER’S LIFE, EVERY DAY FOR OVER A YEAR LETTING THE NEIGHBOURS TAKE RECORDINGS OF HIM WITHOUT HIS KNOWLEDGE ! 

The Dacorum Council Discriminated against Mr Foenander’s state of wellbeing and mental health, did not contact Mr Foenander at any time about any recording equipment and went on to falsify statements against Mr Foenander to have him arrested and detained by the police when Mr Foenander had not done anything wrong and was suffering from the Category 1 Electrical Hazard taking place in Flat 6 Aldwyck court.

Mr Foenander continued to make proper official complaint to all authorities involved but no investigation took place. He started to receive threatening notes being put through his door by Rodney Simmons of No19 Aldwyck Court, Simmons of No 19 continued to hold his ‘Crack Drug’ Parties every week on Friday evenings during 2018 and 2019, while stealing Mr Foenander’s Electricity every time Simmons played his music, as Flat 19 Aldwyck Court was receiving electricity from Flat 6 for FREE due to the faulty electrical installation and the Tampering of Flat 6 Economy 7 electric feed to benefit other flats in the block.

FLAT 5 RESPONSIBLE FOR ILLEGAL RECORDINGS AND HARASSMENT OF OSCAR & ME – ONGOING HARASSMENT OF ‘MUG’ SPRAYED ON MY DOOR!

In reply to one of Mr Foenander’s complaints, Neil Polden Lead EHO of the Dacoroum Council, made false statements in his correspondence of 1st July 2019 that there was a entitlement for the council to install recording equipment in properties surrounding Mr Foenander but it is clear that the equipment had been installed illegally and did not comply with the Housing Act and Mr Foenander’s Human Rights. Neil Polden went on to ignore questions put to him by Alex Mayer (MEP) and to falsify statements in his reply’s which have never been allowed to be heard in court of law.

It is also clear that Mr Foenander was not contacted by the Dacorum Council to seek permission for the recording equipment to be installed which is in breach of the legal process in place for this to take place. Mr Foenander’s solicitor has advised that a correct court order would need to be in place before the equipment was installed and that Mr Foenander would need to be informed that this action was ordered by a court.

The recordings taken, included in the witness statements ‘Analysis of illegal recordings’ served on Mr Foenander, clearly dated the recordings being taken in July 2018, well before any notice of warning had been issued by the council and there was no court order in place.

All of Mr Foenander’s legal rights were breached and avoided by the Dacorum Borough Council while they were fully aware of Mr Foenander’s condition of health and the electrocution and radiation sickness Mr Foenander was suffering from but they totally discriminated against Mr Foenander and his state of health.

FLAT 6 ALDWYCK COURT – CONDEMNED AFTER EVICTION FOE DANGEROUS ELECTRICS

The illegal recordings that had been taking place before any communication was issued by the Dacorum Council, Aldwyck Housing Group and the neighbors involved had led to frther surveillance of Mr Foenander’s movements around Hemel Hempstead which caused him and his dog,Oscar to be harassed every day for over a year and a half.

Mr Foenander’s Human Rights were breached, and he was Discriminated against by the parties involved in the recordings for having a mental health condition which is protected by the Equality Act 2010.

  1. The ICO has specific responsibilities set out in the Data Protection Act 1998, the Freedom of Information Act 2000, Environmental Information Regulations 2004 and Privacy and Electronic Communications Regulations 2003.
  2. The ICO can take action to change the behaviour of organisations and individuals that collect, use and keep personal information. This includes criminal prosecution, non-criminal enforcement and audit. The ICO has the power to impose a monetary penalty on a data controller of up to £500,000.

Mr Foenander complained to the ICO after seeking legal advice but his complaint was shut down despite providing over 40 pieces of clear evidence to the ICO investigating team and is now being left with no choice but to request the involvement of my local MP to raise complaint to the Parliamentary & Heath Ombudsman to investigate the ICO for refusing to investigate my complaints of ‘Illegal Listening In’ and breach of the GDPR.
